Individuals with exceptional skills in the fields of sciences, arts, education, business, or athletics, or those who have achieved remarkable success in the motion picture or television industry and are recognized at the national or international levels, may apply for a Lawful Permanent Resident card in the United States without needing sponsorship from a U.S. employer. This self-petitioning process is permissible under the EB1-A Extraordinary Ability category for any foreign national, whether residing within or outside the U.S.
To initiate the application, the individual must file Form I-140, Petition for Alien Worker, with USCIS and include evidence that they satisfy the category’s specific criteria. It’s also advisable to file a National Interest Waiver petition to bypass the labor certification requirement, thereby asserting that the individual’s presence in the U.S. serves its national interest.
