T Visa

The T visa is a form of protection given to victims of severe forms of human trafficking on the condition that they help government officials in investigating and prosecuting crimes related to human trafficking.

Human trafficking is a crime against humanity where one individual forces another individual through use of force, coercion, or other means, for the purpose of exploiting that individual. Exploitation may be in the form of non-consensual sexual exploitation or forced labor. To qualify for T non-immigrant visa status, an individual must demonstrate that he or she:

• Is physically present in the United States, American Samoa, the commonwealth of the Northern Mariana, or at a port of entry due to trafficking
• Is or has been a victim of a severe form of trafficking
• Must be willing to help government officials in the investigation or prosecution of human trafficking and
• Would face extreme hardship if forced to leave the United States

It is worth mentioning here that T visa regulations are more stringent those for U Visa. Only a victim of a severe form of trafficking is eligible for a T visa. Trafficking victims who fulfill some, but not all, requirements for a T visa may qualify for a U Visa instead. Trafficking is listed as one of the grounds for which U visa is available to provide an alternative form of relief for trafficking victims.
