The E-3 visa is an exclusive work visa designed specifically for Australian citizens to engage in employment within a “specialty occupation” in the United States. A “specialty occupation” is defined as a role necessitating advanced knowledge and a bachelor’s degree or its global equivalent. Eligibility for this visa requires an Australian to possess at least a bachelor’s degree or its equivalent, or have cumulative experience that equates to a U.S. bachelor’s degree. Moreover, the applicant must have a formal job offer from an American employer. Spouses and unmarried children under 21 of E-3 visa holders are eligible for the E-3D dependent visa. These dependents are not required to hold Australian nationality. An E-3 visa holder’s spouse is authorized to seek work permission upon entry into the United States in E-3D status.
E-3 visa holders and their dependents can be granted a stay in the U.S. for up to two years, with the possibility of renewals in two-year increments. This can continue provided that the visa holder remains eligible under the E-3 visa conditions.
