E-3 Australian Visa

The E-3 visa is an exclusive work visa designed specifically for Australian citizens to engage in employment within a “specialty occupation” in the United States. A “specialty occupation” is defined as a role necessitating advanced knowledge and a bachelor’s degree or its global equivalent. Eligibility for this visa requires an Australian to possess at least a bachelor’s degree or its equivalent, or have cumulative experience that equates to a U.S. bachelor’s degree. Moreover, the applicant must have a formal job offer from an American employer. E-3 visa petitions are exclusively processed by U.S. Consulates and cannot be filed domestically within the U.S. The U.S. Consulate General in Sydney provides details on the E-3 visa at the Canberra Usembassy website, and the State Department offers additional information at the Travel State website.

Eligibility for Dependents

Spouses and unmarried children under 21 of E-3 visa holders are eligible for the E-3D dependent visa. These dependents are not required to hold Australian nationality. An E-3 visa holder’s spouse is authorized to seek work permission upon entry into the United States in E-3D status.

Duration of Stay

E-3 visa holders and their dependents can be granted a stay in the U.S. for up to two years, with the possibility of renewals in two-year increments. This can continue provided that the visa holder remains eligible under the E-3 visa conditions.

Documentation Required for the E-3 Visa

  • The certified Labor Condition Application from the Department of Labor
  • Evidence that the U.S. employer is financially capable of paying the promised wages, alongside a bona fide job offer
  • The employment contract between the U.S. employer and the Australian employee
  • Documentation proving that the position qualifies as a specialty occupation
  • Certifications that the Australian national holds the necessary degree or its equivalent to a U.S. four-year degree
  • If the position demands a professional license or permit, a copy of such authorization

Inderjit handled our immigration matter in reference to my parents. We approached him and found him extremely pleasant to work with. In addition to his knowledge of the law, he guided us very well throughout the process. I would recommend him very strongly to anyone in matter of immigration.
